Terms of Service

01Acceptance

By using Smart Serve (the POS, the management dashboard, or your own ordering website) you agree to these Terms on behalf of your business. If you don't agree, please don't use the service.

02Our Services

Smart Serve gives your business:

• Point of Sale: take orders and payments in a few taps.
• Cash Control: opening cash, sales, expenses and a running drawer total.
• Staff & Roles: separate owner and staff logins, with attendance.
• Reports: sales by day, month, item and payment method, exportable to CSV.
• Ordering Website: a branded site where your customers browse what you sell and order online, linked to your POS.
• Works Anywhere: runs in any browser, nothing to install.

Features are added and refined over time. We may change or retire parts of the service, and will give you reasonable notice before removing something you rely on.

03Accounts & Staff

Owners are responsible for their account, all staff logins created under it, and any activity that happens through them. Please keep credentials private and remove access for staff who leave.

Tell us promptly if you think an account has been misused, so we can help you secure it.

04Payments

Fees follow the plan agreed at onboarding. Continued use after a billing cycle means you agree to pay for it. Unpaid accounts may be suspended, including access to the ordering website.

Fees already paid for a billing cycle are non-refundable, except where we have clearly failed to provide the service or the law requires otherwise. We will give you advance notice before any price change.

05Your Responsibilities

Keep your catalogue, pricing, and business details accurate, use Smart Serve for lawful business purposes only, and don't attempt to copy, resell, or reverse-engineer the system.

You are responsible for what your staff enter. The system records what it is told. It cannot verify that a price, an expense, or a cash count is correct.

06Data & Privacy

Your sales, catalogue, staff, and customer order data belong to you. We use it only to run and improve the service for your business, and never sell it to third parties.

The service runs on trusted infrastructure providers who host the application and database on our behalf. Your data is stored on servers outside Pakistan (currently in Singapore), which is normal for cloud software and helps keep the system fast in this region.

We may access your data when you ask us for support, or where we need to in order to keep the service running securely.

07Data Retention & Backups

To keep the system fast and within its storage limits, detailed sales and expense history is kept for the current calendar year plus the full previous year. Older records are deleted automatically. Your customer list is not affected by this.

This means history older than roughly two years will not be available in the system. If you need to keep records for longer, whether for tax, audit, or your own reasons, export them to CSV from the Reports screen before they age out. We recommend doing this at least once a year.

Deletion is permanent and we cannot recover data once it has been removed.

08Availability

Smart Serve needs an internet connection to work. We aim for high uptime but can't guarantee zero downtime, so keep a basic manual backup method for rare outages.

We may occasionally take the service down briefly for maintenance or updates.

09Liability

Smart Serve is provided "as is." We're not liable for indirect losses such as lost sales, lost profits, or entry errors made by your staff. Where we are liable, our total liability is limited to the fees you paid us in the three months before the issue arose. Nothing here limits liability that the law does not allow us to limit.

10Termination

Either side can end the agreement per your onboarding terms, or with reasonable notice. We may suspend accounts for non-payment or misuse.

You can request a full export of your data for 30 days after termination. After that, your data may be permanently deleted.

11Governing Law

These Terms are governed by the laws of Pakistan, and the courts of Pakistan will have jurisdiction over any dispute. We will always try to resolve issues with you directly first.

12Changes & Contact

We may update these Terms as Smart Serve grows, and will notify you of major changes. Continued use after a change means you accept the updated Terms.
